Agreement to These Terms

These Terms and Conditions (the "Terms") are a binding agreement between you and Super Fiber Inc. ("SuperFiber," "we," "us," or "our"). They govern your use of superfiber.com (the "Site") and your purchase of our products and subscriptions. SuperFiber was previously sold under the Bellway name, and these Terms also apply to purchases and use under that name.

By accessing the Site, creating an account or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Eligibility

You must be at least 18 years old to use the Site or buy from us. By using the Site, you confirm that you are 18 or older and able to enter into a binding contract.

Your account

You may be asked to create an account. Give us accurate and current information, and keep your login details confidential. You are responsible for all activity under your account. Tell us right away if you think it has been used without your permission. We may suspend or close an account that violates these Terms.

Orders, Payment, Subscriptions, Shipping and Returns

Orders and pricing

When you place an order, you are making an offer to buy. We accept it when we ship your products or send a shipping confirmation. We may decline or cancel any order, for example because a product is unavailable, a price or description contains an error, we suspect fraud, or the order exceeds a quantity limit. If we cancel an order after charging you, we will refund the charge.

Prices are in U.S. dollars and may change at any time. Prices do not include shipping and applicable sales tax, which are added at checkout. Promotional codes and discounts are subject to their stated terms, cannot be combined unless we say so, and have no cash value.

Payment

You agree to pay the total shown at checkout, including taxes and shipping. You confirm that you are authorized to use the payment method you provide. Our third-party payment processors handle your payment details.

Subscriptions

If you choose a subscription, you authorize us to charge your payment method on the schedule you select until you cancel. Each shipment is billed when it is processed. You can skip, change or cancel a subscription at any time through your account or by contacting us. To avoid the next charge, make the change before the next scheduled shipment. Subscription prices and discounts may change, and we will give you notice before a change takes effect.

Shipping and returns

We ship within the United States. Delivery dates are estimates, not guarantees, and risk of loss passes to you when the carrier delivers the order. Our Shipping & Returns page explains our shipping options and return and refund policy, and it is part of these Terms. If your order arrives damaged or incorrect, contact us so we can make it right.

Health and Product Disclaimers

Our products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Individual results may vary with daily use as directed.

The content on the Site, including our blog and quiz recommendations, is for general information and wellness purposes only. It is not medical advice and does not create a doctor-patient relationship. Talk to a qualified healthcare provider before starting any supplement, especially if you are pregnant or nursing, take medication, have a medical condition, or are giving a product to a child. Stop use and consult a healthcare provider if you have an adverse reaction.

Read the label and ingredient list before use, and keep products out of reach of children. You are responsible for checking a product for ingredients you need to avoid, such as allergens.

Dietary supplements can contain small, naturally occurring amounts of lead that are safe to consume per FDA guidelines. California Proposition 65 warning: for products purchased in California, this product can expose you to lead, a reproductive toxicant. See p65warnings.ca.gov.

Acceptable Use, Intellectual Property and Content

Acceptable use

You agree not to:

• Break any law or violate anyone's rights while using the Site
• Use bots, scrapers or other automated tools to collect data from the Site without our written permission
• Interfere with the Site's security or operation, or try to access accounts, systems or data that are not yours
• Introduce viruses or other harmful code
• Buy products for resale through misleading means or in violation of any purchase limits
• Submit false, misleading or fraudulent information, including false orders or payment details

Our intellectual property

The Site and its content, including the SuperFiber and Bellway names, logos, product names, designs, text, images, quiz and software, belong to Super Fiber Inc. or its licensors and are protected by trademark, copyright and other laws. We give you a limited, non-exclusive, revocable license to view the Site and use it for your personal, non-commercial purposes. You may not copy, modify, distribute, sell or create derivative works from any part of the Site without our written permission.

Reviews and content you submit

If you submit a review, photo, comment or other content, you confirm that you own it or have the right to share it, and that it is truthful and does not violate any law or anyone's rights. You give us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit, display and distribute it in connection with our business and marketing. We may remove any content at our discretion.

Third-party links

The Site may link to third-party websites and services, including retailers such as Amazon. We do not control them and are not responsible for their content or practices. Your use of them is at your own risk and subject to their terms.

Disclaimers and Limits on Liability

Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. This does not limit any warranty that the law does not allow us to exclude.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, SUPER FIBER INC. AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR YOUR PURCHASES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.

Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to defend and indemnify Super Fiber Inc. and its officers, employees, contractors and affiliates against claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third party's rights.

Disputes, Governing Law, Changes and Contact

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that we do not resolve informally will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. Before filing a claim, please contact us and give us 30 days to try to resolve the issue.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Changes apply to your use of the Site after they are posted. Orders you placed before a change are governed by the Terms in effect when you placed them.

General terms

These Terms, together with our Privacy Policy and Shipping & Returns page, are our entire agreement with you about the Site. If a court finds part of these Terms unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent, but we may transfer ours, including in a merger or sale of the business.
